Wah! SmartDeals — Customer Privacy Policy

This Privacy Policy explains how WahSmartDeals LLC ("Wah!", "we", "us") collects, uses, shares, stores, and protects personal information when you use the Platform as a customer. It should be read with the Customer Terms of Use, Cookie Policy, Disclaimer, and Account Deletion Policy.

Wah! is a technology marketplace that connects customers with independent local vendors across several deal types: Retail, Non-Recurring and Recurring service deals (for example, home improvement), Entertainment tickets, and Consultation / referral deals. Because these deal types work differently, the information shared with a vendor also differs — see Section 3.

Payment metadata Processor references, status, last four digits / card brand, reconciliation records — collected only where in-app payment is enabled. We do not collect customer card data for cash-only deals (including Phase 1 Retail), and Wah! does not store full card numbers. Our payment processor (Stripe), when in-app payment is used.
Review & reward Review submissions and any photos you attach, your promotional-use consent for those photos, eligibility checks, external-review verification, cashback/reward credits and reversals. You, and automated verification.
Technical usage App/browser telemetry, diagnostics, logs, push-notification tokens, and cookie/tracking signals (see Cookie Policy). We may collect technical and log data even if you browse without an account. Automatically, from your device.

3. How we share your information — by deal type

We do not sell your personal information for money. What a vendor receives depends on the deal type and on whether a step is operational fulfilment (claiming or redeeming a coupon) or analytics/reporting:

The vendor does not receive your phone, email, or address for these deal types. Entertainment tickets may be transferable; if you choose to share a ticket, the person you send it to receives the ticket or QR code you send.
Non-Recurring and Recurring service deals (e.g., home improvement) Because the vendor performs a service for you, the vendor receives what is needed to schedule and deliver the service, which may include your name, contact details, and service address.
Consultation / referral When you select or request a consultation or referral deal (for example, home-theater setup, landscaping, or other custom work), you direct us to share your name, contact details, service address, and the project details you provide with the single vendor matched to that deal in your community, so that vendor can contact you directly to discuss and arrange the work. You consent to that vendor contacting you by phone, text message, or email for that purpose. Because only one vendor serves a given category in your community, your information goes to that one selected vendor — it is not sold or broadcast to multiple buyers.

Vendor as independent party. Once a vendor receives your information for a service, consultation, or referral deal, the vendor uses that information as an independent party under its own privacy practices and applicable law. Wah! is not responsible for a vendor's separate use of your information. You may ask a vendor to stop contacting you, and you may contact us for help.

We also share information:

We do not sell your personal information for monetary consideration, and we do not share it for cross-context behavioral advertising in exchange for payment. Sharing your details with a vendor you selected is done at your direction to deliver the deal you requested. Where applicable law treats any such disclosure as a "sale" or "share," you may opt out as described in Section 14.

4. Service providers and subprocessors

We use trusted service providers strictly to operate, secure, and improve the Platform. They are bound by contractual and legal controls and may use your information only for the purposes below.

This list may change as our providers evolve; we will keep this policy reasonably current.

5. Automated processing and AI

We use automated tools to operate and protect the Platform, including to detect fraud and abuse, to assess reward and review eligibility, and to verify content. For example, when you submit a review together with an external-review screenshot for cashback verification, an automated vision model (provided by our AI service provider) checks whether the screenshot matches your in-app review. These tools support — and do not solely determine — decisions that significantly affect you; where a reward is withheld or reversed, you may contact us to request human review. You may opt out of certain profiling as described in Section 14. We do not permit our AI service providers to use your personal information to train their models for their own purposes.

6. Payments

Wah! does not hold, escrow, or process customer payments for vendor sales, and does not store your full payment card number. For many deals — including Phase 1 Retail — you pay the vendor directly, often in cash, and Wah! does not collect your card data at all. Where in-app payment is enabled for a deal type, it is handled by our third-party payment processor (Stripe) under its own terms; Wah! may receive only limited information such as the last four digits, card brand, and transaction status for display and reconciliation.

7. Sensitive personal information

We collect a limited amount of information that may be considered "sensitive" under laws such as the CPRA — primarily your account log-in and authentication credentials, and, where you provide a service address, information that could indicate your general location. We use this information only to provide and secure the Platform (for example, to authenticate you, prevent fraud, and deliver services you request) and not to infer characteristics about you. We do not sell sensitive personal information or share it for cross-context behavioral advertising. Where applicable law gives you the right to limit the use of sensitive personal information, you may exercise it as described in Section 14; because we already limit our use to these permitted purposes, exercising it may not change how we handle your data.

8. Rewards and cashback program

We offer an optional cashback reward for eligible reviews. When you complete a qualifying review after redemption, we credit virtual wallet credits — currently 1% of your coupon subtotal (before tax) — funded by Wah!. Participation is voluntary: you are not required to leave a review or join the program to use the Platform. We provide this notice where required by financial-incentive rules such as the CPRA. The reasonable value of the incentive to us relates to the engagement and feedback a review provides, which we estimate is approximately equal to the credit issued (about 1% of the subtotal). Credits are promotional, have no cash value, are not currently redeemable at checkout, and may be withheld or reversed for fraud, abuse, or policy violation as described in the Terms of Use. You may withdraw from the program at any time simply by not submitting reviews.

9. Legal basis and consent

Where required by law, we rely on one or more lawful bases: contract performance, legitimate interests, legal compliance, and consent (for specific marketing/cookie uses where applicable). You may withdraw consent where legally allowed.

10. Data retention

We retain personal data only as long as necessary for the purposes in this policy. Retention varies by category:

Records we must keep by law are retained for the required period even after you delete your account.

11. Security

We use administrative, technical, and organizational safeguards designed for the sensitivity of data processed, including encrypted transmission and role-based access. No system is guaranteed to be perfectly secure, and you should also protect your account and device credentials. If a data breach affecting your personal information occurs, we will notify you and the relevant authorities as required by applicable law.

12. International transfers

We primarily process personal data in the United States. Where data is processed in other countries by us or our service providers, we implement reasonable safeguards (such as standard contractual clauses) as required by applicable law.

13. Your rights and controls

Subject to local law, you may request access, correction, deletion, restriction, portability, or objection. Some requests may be denied where exemptions apply (for example fraud prevention, legal compliance, or active disputes). You may submit a request by emailing admin@wahsmartdeals.com or through your in-app account settings (including the account-deletion flow) — more than one method is available to you. We may require identity verification before processing requests. You can also request deletion of your account through the in-app process described in the Account Deletion Policy.

14. U.S. state privacy rights (California, Texas, and other states)

Depending on your state of residence — for example, California under the CCPA/CPRA, Texas under the Texas Data Privacy and Security Act, and similar laws in other states — you may have the right to: confirm whether we process your personal data; access, correct, or delete it; obtain a portable copy; opt out of targeted advertising, the "sale" of personal data, or certain profiling; and limit the use of sensitive personal information.

We do not sell your personal information for monetary consideration and do not share it for cross-context behavioral advertising in exchange for payment. To exercise any right, or to submit a "Do Not Sell or Share My Personal Information" request, email admin@wahsmartdeals.com or use your in-app account settings. Where required by law, we will treat a recognized opt-out preference signal — such as Global Privacy Control (GPC) — as a valid opt-out of sale/share to the extent we engage in such activity and as we implement support for it on our website. We will respond within the timeframe required by applicable law and may verify your identity before acting. You may appeal a denial by replying to our written response, and we will provide a written explanation of our appeal decision; you will not be discriminated against for exercising these rights; and where we rely on consent you may withdraw it as easily as it was given. You may use an authorized agent where the law permits.

California "Shine the Light" (Civil Code §1798.83). We do not share your personal information with third parties for those third parties' own direct-marketing purposes, so this law generally does not apply; you may contact us with any questions.

15. Children and families

The Platform is not directed to or intended for individuals under 18. We do not knowingly collect personal information from children under 13 (or the minimum age of digital consent in your jurisdiction). Where a household member under 18 uses the Platform, it must be through an adult account holder's account, as described in our Family and Age Suitability Policy. If we learn we have collected information from a child under 13, we will take reasonable steps to delete it. A parent or guardian with concerns may contact admin@wahsmartdeals.com.

16. Communications and notifications

We send account, security (including one-time passcodes), transactional, and service messages by SMS/text, push notification, and email; these are necessary to operate your account. Promotional messages are separate and optional, and you may opt out as described in the Terms of Use. Push notifications rely on a device token, which you can disable in your device settings.

17. Third-party links and services

The Platform may contain links or integrations to third-party services, including vendors' own sites. Their privacy practices are governed by their own terms and policies, not this policy.

18. Jurisdiction-specific notices

Depending on your jurisdiction, additional privacy rights, disclosures, and complaint mechanisms may apply. If any part of this policy conflicts with mandatory local law, the mandatory local law controls for that scope.

19. Changes to this policy

We may update this policy and will post the revised version with an updated effective date. For material changes, we will provide reasonable notice (such as by in-app prompt, email, or notification). Continued use after the effective date constitutes acknowledgment to the extent permitted by law.
